2. General terms

These Terms of Service apply to purchases made on pondcph.dk and pondcph.com. By placing an order, you accept these terms.

POND cannot guarantee that all styles, items, colours and sizes are in stock. If a problem occurs with your order, we will contact you by email. Please make sure to enter valid contact information when placing an order.

We reserve the right to cancel an order in case of price errors, stock errors, suspected fraud, payment issues or other obvious irregularities.

3. Orders and order confirmation

When you place an order, you will receive an automatic order confirmation by email. The order confirmation confirms that we have received your order. A binding agreement is formed when your order has been accepted by POND.

If we are unable to deliver according to the order confirmation, we will contact you and give you the opportunity to cancel the order and receive a refund.

4. Prices and payment

All prices are shown in the currency selected at checkout. Taxes and import duties are calculated at checkout. Where import duties apply, POND ships DDP (Delivery Duty Paid), so no additional duties or import taxes should be charged to you upon delivery.

We accept Apple Pay, Google Pay and major payment cards including Dankort, VISA/Dankort, Visa, Visa Electron, Eurocard, Mastercard and American Express. Available payment methods may vary by country and checkout provider.

Your payment may be authorised when you place the order and captured according to the rules of the selected payment method and applicable law.

5. Shipping and delivery

We process and ship orders on weekdays. Delivery times are estimates and may vary depending on destination, courier operations, customs clearance and circumstances outside our control.

Please see the Shipping & Delivery page for current shipping prices, estimated delivery times and duties/taxes information. Taxes and import duties are calculated at checkout and, where import duties apply, orders are shipped DDP.

6. Taxes and duties

POND ships DDP (Delivery Duty Paid) in all markets where duties apply. Taxes and import duties are calculated at checkout. No additional import duties or import taxes should be charged to you upon delivery.

If a package is refused or left unclaimed, any shipping, return, handling or courier costs charged to POND as a result may be deducted from your refund where permitted by law.

7. Right of withdrawal and voluntary returns

Consumers in the EU normally have a statutory 14-day right of withdrawal for online purchases. POND also offers an extended 30-day return period from the date you receive your product.

All returns must be registered through our return portal. Return label fees apply (except for Denmark). Products must be returned unworn, unwashed, neatly folded and in their original packaging with all tags and hygiene protection intact. For hygiene reasons, we may refuse products that have been worn, washed, stained, damaged, altered or returned without original packaging, tags or hygiene protection, or refund them only partially where permitted by applicable law.

Return label fees apply and will be deducted from your refund, except for Denmark where the return label is free of charge. Original shipping fees are refunded for Denmark, EU, UK and Norway. Original shipping fees are not refunded for the US, Australia, Switzerland and rest of world.

For US, Australia, Norway, Switzerland and rest of world orders, prepaid duties, import taxes, customs fees and carrier clearance fees are not refunded by POND and will be deducted from the refund amount.

8. Faulty products and complaints

If you receive a wrong, missing, damaged or faulty item, please contact us as soon as possible at sos@pondcph.dk with your order number.

Consumers in Denmark and the EU have statutory rights when goods are faulty, including a two-year legal guarantee under Danish consumer law. Nothing in these terms limits your mandatory consumer rights.

9. Product use and DryDock Pocket™ disclaimer

The DryDock Pocket™ is designed as a removable waterproof pocket insert tested waterproof down to 30 metres. It must be closed and used correctly. Any use of the DryDock Pocket™ for phones, electronics, cards, keys, jewellery or other valuables is at the customer's own discretion. POND is not liable for damage to or loss of valuables stored in the DryDock Pocket™, except where liability cannot be excluded under mandatory law.

10. Pre-orders

When you buy products on pre-order, you accept to pre-pay the order and that delivery will take longer than usual. The estimated shipping date is displayed on the product page. Shipping dates are estimates and cannot be guaranteed.

Pre-orders can be cancelled until dispatch from our warehouse. Cancelled pre-orders are entitled to a full refund before shipment.

If your order contains both stocked and pre-ordered items, the full order will ship when all items are in stock. If you want stocked items delivered immediately, place a separate order for those items.

11. Intellectual property

All rights, including copyrights, design rights, trademarks and other intellectual property rights connected to POND products, product names, technologies, imagery, text, trademarks and other distinctive marks belong to Pond Cph ApS or its licensors and suppliers.

You may not use, reproduce, copy, modify, publish, transmit, distribute, display, download, license, create derivative works from, reverse engineer, frame, transfer or sell any POND content without prior written consent from POND.

12. Force majeure

POND is not liable for delay or failure to fulfil an agreement caused by circumstances outside our reasonable control, including but not limited to war, civil unrest, government restrictions, strikes, lockouts, transport disruption, natural disasters, pandemics, cyber incidents, supplier failure or similar events. If such circumstances occur, we will attempt to notify you as soon as reasonably possible.

13. Governing law and complaints

These terms are governed by Danish law, without limiting any mandatory consumer protection rights that apply in your country of residence.

If you have a complaint, please contact us first at sos@pondcph.dk so we can try to resolve the matter.

Consumers may also be able to complain through relevant Danish consumer complaint bodies, including the public consumer complaints system in Denmark, or seek guidance through the European Consumer Centre network for cross-border consumer issues.
